Legislative Impact Assessment for Digital Infrastructure Operator
Supporting a digital infrastructure operator assess proposed legislation, benchmark it against international frameworks, evaluate the operational and contractual implications, and develop an evidence-based response to the relevant authority.
Background
A digital infrastructure operator engaged Stratenium to assess the implications of proposed legislation for its business.
The client required an operator-informed view of the legislative framework, its alignment with international practices, and the potential impact of the proposed obligations on existing operations and contractual commitments. Stratenium also supported the client in developing its initial response and recommendations to the relevant authority.
Our Approach
Legislative and Policy Review
Conducted a structured review of the proposed legislation, consultation materials, supporting literature and broader policy context. This helped clarify the legislative intent, proposed scope and applicability, potential obligations, implementation considerations, and areas requiring further interpretation.
International Benchmarking and Scanning
Benchmarked the proposed framework against relevant international legislation, standards and regulatory practices. This provided context on how comparable requirements had been structured and implemented in other jurisdictions, while highlighting material differences in scope and approach.
Operational and Contractual Impact Assessment
Addressed the potential implications for the client’s operating model, systems, processes and governance arrangements. We also identified risks relating to existing and in-flight contracts, implementation dependencies, transitional arrangements and potential areas of commercial and operational exposure.
Drafting of Response to Public Consultation
Assisted the client consolidate its key concerns, supporting rationale and recommended positions into an initial response to the relevant authority. The response balanced the policy objectives of the proposed legislation with practical considerations relating to implementation, operational feasibility and existing contractual obligations.
Outcome
Provided the client with a structured view of the proposed legislation, its potential impact on the business and the areas requiring further engagement or preparation.
The work enabled management to develop an evidence-based position, respond within the required timeframe and begin assessing the operational, contractual and governance changes that could be required if the proposed legislation were enacted.
